Sub-section (1) of Section 48 of the Planning and Development Act, 2000 (as amended) enables a planning authority, when granting a planning permission under Section 34 of the Act, to include conditions requiring the payment of a contribution.  This contribution is in respect of public infrastructure and facilities benefiting development in the area of the planning authority and that is provided, or that is intended will be provided, by or on behalf of the local authority (regardless of other sources of funding for the infrastructure and facilities).

Section 48 also requires that the basis for the determination of a contribution shall be set out in a development contribution scheme made under the section. A scheme may make provision for payment of different contributions in respect of different classes or descriptions of development and due to decreases/increases in prices, shall allow for annual updates during the life of the scheme.

The schemes below as adopted by the elected members of the local authority are applicable in the South Dublin County Council administrative area.

Development Contribution Scheme 2013-2015
Notice is hereby given that on 14th January 2013 South Dublin County Council made a Development Contribution Scheme for the period 2013 – 2015, details are as follows:

€81.65 per square metre of development

Residential Development

€88.27 per square metre of development

The above rates shall be fixed from 15th January 2013 to 31st December 2014. The rate of contributions for the period 1st January 2015 to 31st December 2015 shall be determined at the appropriate time in consideration of any changes in the Tender Price Index in the intervening time. The commencement of the Scheme becomes effective for decisions to grant permission from 15th January, 2013.

Development Contribution Scheme 2010-2017.
This scheme was applicable for permissions granted from January 1st 2010-January 14th 2013 inclusive.
On 14th December 2009 South Dublin County Council made a Development Contribution Scheme for its administrative area for the period 2010-2017, details were as follows:

The Scheme was effective from 1st January 2010 and applicable to all grants of planning permission made from that date. However, following the adoption of the 2013-2015 Scheme, the 2010-2017 Scheme is no longer applicable to grants of planning permission made on or after January 15th 2013. Permissions already granted in the lifetime of this scheme, i.e. January 1st 2010-January 14th 2013, will however, once availed of, be required to adhere to the planning conditions contained in the permission implemented and pay the stated contribution as per planning conditions.

Development Contributions Scheme 2004-2009
This scheme was applicable for permissions granted in the period January 1st 2004 to 31st December 2009.
Permissions already granted in the lifetime of this scheme, i.e. January 1st 2004-December 31st 2009,  once availed of, are required to adhere to the planning conditions contained in the permission implemented and pay the stated contribution as per planning conditions.

Supplementary Development Contribution Scheme 

The provisions of Section 49 of the Planning and Development Act 2000 (as amended) empower the elected members to make a supplementary development contribution scheme in respect of any public infrastructure service or project that will benefit the development to which the permission relates when carried out.

Kildare Route Project Supplementary Development Contributions Scheme:
In accordance with the provisions of Section 49 of the Planning and Development Act, 2000 (as amended) a Supplementary Development Contribution Scheme for the Kildare Route Iarnrod Eireann Project was adopted on 10th December 2007 and became effective for permissions granted within the applicable area (see map below) from January 1st 2008.

Metro West Supplementary Development Contribution Scheme
In accordance with the provisions of Section 49 of the Planning and Development Act, 2000 (as amended) a Supplementary Development Contribution Scheme for the Metro West Project was adopted on 9th March 2009.

However following the announcement of the suspension of the Metro West Project by the Minister for Transportation, Tourism and Sport, Leo Varadkar TD, the elected members of South Dublin County Council resolved on 10th October 2011 to suspend the Metro West Supplementary Development Contributions Scheme.  Notifications as applicable have issued to affected parties.
